Update: Success in Setting Aside an Injunction Order

On 15-9-2020, our Partner Mr CM Lai and Datuk Jacob Goldie acting for the Kuantan Chinese Chambers of Commerce and Industry ("KCCCI") has successfully set aside an injunction order to halt the Annual General Meeting ("AGM") of KCCCI from taking place.
The said case took place at the Kuantan High Court before Yang Arif Dato' Haji Zainal Azman bin Ab. Aziz. The presiding judge accepted our submissions that injunction order given earlier ought to be rejected as such order is contrary to the Order 29, rule 1 (2C) of the Rules of Court 2012 as follows:-
"A Court shall not grant an injunction on an ex parte application if the effect is to stop the holding or progress of a meeting of a body corporate, a society, an association, a union, an organization, a club or any other body of persons however constituted or named."
The KCCCI expressed their utmost gratitude by presenting a memento of appreciation to Mr CM Lai. We will continue to act as a legal adviser to KCCCI for the future. We wish our client the greatest success in their endeavour.
